The Residential Tenancies Act allows landlords to apply to raise the rent above the annual rent increase guideline amount.  The guideline amount for 2008 is 1.4%A landlord can apply for an Above Guidline Rent Increase (AGI) to cover:

  • Capital expenditures (repairs or renovations other than normal ongoing maintenance)
  • An "extraordinary" increase in property taxes
  • Heating, water or hydro costs
  • Increased costs of security services
  • Addition of new services

Before an AGI becomes legal, it must be approved by the Landlord and Tenant board (LTB).

A hearing must be held, and tenants have the right to challenge the increase.
